Registering a sale deed in Chennai: the process, the costs, and what goes wrong

Registration is the step that makes a transfer legally effective. It is also mechanical enough that people assume it needs no advice: until stamp duty is short-paid, a name is misspelt, or the deed omits something that matters years later.

Registration is not the last step. Until the patta and property tax records are changed into your name, the government record still shows the seller as owner. That gap is where a surprising amount of later trouble originates.

Guideline value, and why the duty is often disputed

Stamp duty is levied on the guideline value fixed for the location if that exceeds the price actually paid. Buyers occasionally attempt to under-declare; the risk is a deficit stamp duty demand later, with penalty, and a document that can be impounded.

Where the guideline value is genuinely higher than the market value of a particular property (because of its condition, access or a defect), there is a procedure to have the valuation reconsidered. It is worth using rather than simply paying or under-declaring.

Other transfers, and their traps

Gift deeds between close relatives attract concessional duty in Tamil Nadu but must be genuine gifts, accepted during the donor’s lifetime. Settlement deeds within a family are widely used and equally widely litigated where the recitals are loose.

Release deeds between co-owners, partition deeds, and transfers under a will each have their own requirements. The common failure is using the wrong instrument for the transaction actually intended: a mistake that surfaces only when the next sale is being examined.
