A legal opinion before you pay: the cheapest insurance in any property purchase

A title problem found before the sale deed is a negotiation. The same problem found afterwards is a decade of litigation. A written legal opinion is the difference, and it costs a fraction of one percent of what you are about to spend.

A legal opinion examines the chain of title, typically over 30 years, together with the encumbrance certificate, patta and revenue records, approvals and tax receipts.

It ends in a written opinion: clear, clear with conditions, or not recommended, with the reasons stated.

What the opinion actually examines

A proper opinion is not a glance at the sale deed. It reconstructs how the seller came to own the property and tests every link in that chain.

Chain of title. Parent documents traced back, ordinarily thirty years, checking that each transfer was validly made by someone entitled to make it.Encumbrance certificate. The registered mortgages, sales and attachments recorded against the property over the search period.Patta, chitta and revenue records. Whether the revenue record matches the document and the actual extent.Approvals. CMDA or DTCP layout approval, building plan approval, and completion or occupancy where relevant.Statutory dues. Property tax, water and electricity arrears, and any pending demands that would travel with the property.Litigation and attachment. Pending suits, court attachments, and whether a caveat or lis pendens affects the property.

The problems we find most often

Unreleased mortgages where the loan was repaid but no discharge was registered. Missing links in the chain, where one earlier transfer was never properly documented. Properties inherited but never partitioned, sold by one co-owner as though the whole belonged to them.

Also common in Chennai: agricultural land sold as residential without conversion, layouts without approval, and constructions that deviate from the sanctioned plan. Each of these is manageable if known in advance and expensive if discovered later.

What you get, and when

A written opinion setting out the chain, the documents examined, the defects found, the risk each defect carries, and what should be obtained or rectified before completion. Where the title is clear subject to conditions, we specify exactly what those conditions are.

Most opinions are delivered within a few working days of receiving the documents. Where a document has to be traced from the Sub-Registrar’s office, it takes longer: which is another reason to start before you have committed to a closing date.

Legal opinions: buyers ask

My bank is giving a loan. Is their legal opinion enough?+

Not really. The bank’s opinion protects the bank’s security interest, not your enjoyment of the property. It may accept risks that matter to you but not to a lender with a mortgage over the asset.

How far back should the title be traced?+

Thirty years is the standard search period, and it is what most institutional lenders require. In certain cases (inherited property, trust property, or land with a complicated history) we recommend going further.

Can you check a property before I pay the advance?+

Yes, and that is the right sequence. A preliminary check on the EC and parent documents can be done quickly, with the full opinion following once all documents are made available.
